Book of Financial And Legal Conditions of The External Tender for The Import of Red Lentil Seeds – Crushed Red Lentil – White Chick peas – Dry White Kidney beans - Dry Thin White Beans – Dry Round beans .
Submission of Offers :
Bids are submitted to the Establishment Office located on Zablatani – New Alhal Souq , P. O. Box 5603 in a sealed envelope addressed to the Name of the Establishment . The bidder writes his name, address , fax No. , telephone No, advertisement No and its subject and it should contain two sealed envelopes :
The First Envelope should contain the bid bond, the purchase receipt of the Special Conditions and the following credentials :
- A participation application bearing a revenue stamp of Syrian Pounds 1 000/= .
- A bidder’s declaration that he had studied the Books of Special And Ge3neral Conditions and his abidance by their regulations and conditions .
- A bidder’s declaration that he has not dealt with Israel in any way whatever .
- A bidder’s declaration that he has not been deprived of participating in the public sector tenders in Syria or contracting with the public sector parties in Syria .
- A bidder’s declaration that his funds are not under reservation or executive attachments in favour of the public authorities of the Syrian Arab Republic .
- A bidder’s declaration that he has studied the Syrian Standards for the required materials .
The second envelope shall contain the financial offer :
It should be in Euro individually and wholly without rubbing , scratching or insertion and the offer shall not contain any reservations or financial, legal or technical conditions and if they are stipulated they will be neglected .
Bid Bond : it is 2% of the offer value in Euro and it is to be submitted by a bank guarantee issued by an accredited resident bank in Syria or in cash deposited to the Establishment account with the Commercial Bank of Syria , Branch No. 6 in Damascus or in cash to the treasury of the Establishment or a certified cheque in favour of the General Establishment for Warehousing And Marketing . The bid bond is to be submitted within fifteen days from the date of notification of the candidate bidder that he has been awarded the tender and before signing the contract .The bid bond can be considered a performance bond if the bid bond is submitted in any form other than a bank guarantee provided that the bidder pay the difference between the two bonds , but if the bid bond is submitted by a bank guarantee, it should be replaced by a performance bond which will remain valid until the completion of the contract and the submission of a document from the Syrian General Establishment for Maritime Shipping stating that the shipping was done by it or by its approval .
Method of Payment .
The value of the supplied quantities shall be paid on the basis of their net weight stated in the receipt reports drawn by the receipt committees without reservations after deducting the weight of the packing material from the gross weight .This will be done through a divisible documentary letter of credit and a letter from The General Establishment for Warehousing And Marketing to the Commercial Bank of Syria to release the amounts against the submission of the following documents to the Commercial Bank of Syria in favour of The General Establishment for Warehousing And Marketing :
- A commercial invoice of seven copies signed by the seller , one of them should be authenticated by the chamber of commerce of the country of origin and the embassy or consulate of the Syrian Arab republic in the country of origin or by any party taking its place . All authentication fees shall be paid by the contractor .
A whole set of shipping documents clean and clear of any reservations in favour of The General Establishment for Warehousing And Marketing stating that the shipping charges are prepaid .
- A certificate of the weight and type of goods of seven copies confirming that the seeds are in accordance with the specifications stipulated in the Technical Conditions Book .
Delay Penalty :
In case the contractor delays the supply of the quantities stated in the contract, a 0.003% ( three per thousand ) delay penalty shall be imposed on him for each day of delay the of the quantity not delivered provided that the total penalties do not exceed 20% of the contract total value and the delay penalty shall be deducted from the value of the delivered quantities before the payment of their value .
Execution Period :
The Execution Period shall be forty five days effective from the date notifying the contractor of the opening of the documentary letter of credit .
Receipt :
- The seeds shall be received CIF on board of the Establishment carriers in one of the following ways :
Sea freight on board the Establishment carriers after the shipment is accepted by the competent authorities and the customs clearance by the seller and the preparation of a receipt report duly by the Receipt Committee . All analysis expenses and charges are to be paid by the contractor who also pays all the customs clearance fees, expenses and charges .
Air freight on the Establishment carriers after the shipment is accepted by the competent authorities and the customs clearance by the contractor who pays all the customs clearance fees, expenses and charges .
Land shipping shall be in the places determined by the Establishment after the shipment is accepted by the competent authorities and the customs clearance by the contractor who pays all the customs clearance fees, expenses and charges .
Transport And Freight Conditions :
Sea freight : The forwarder ( contractor ) should include the following points in the sea freight contract :
- The shipping should be exclusively on the Syrian Establishment For Maritime Shipping or through its approval .
- The unloading port shall be Lattakia or Tartos Port .
- The week end begins at 15.30 of Thursday up until 8 am of Saturday and the working day of Saturday ends at 13 hours , other holidays and feast days shall begin at 15.30 of the day preceeding the holiday up until 8 am of the day following the holiday .
Land Freight : The seller shall use the necessary means of transportation which abide by all the technical and health conditions for the safe arrival of the goods as stipulated in the Technical Conditions Book .
Air Freight : It should be by The Syrian Arab Airlines or through its approval .
Insurance : The Contract shall insure the goods with the Syrian Insurance General Establishment and he pays all expenses of the insurance contract .
Termination of Obligation :
a. The contract is inevitably considered terminated without a legal notice or a court judgment if it is proved that the seller depends on the execution of his contractual obligations on in person or through another person , authority 0r others dealing with Israel in any capacity whatsoever and the Establishment has the right to confiscate the bond or cancel the documentary letter of credit and sue the contractor for compensation
b. The Establishment has the right to terminate the contract without a legal notice or a court judgment if it is proved that the contractor is cheating , falsifying or committing fraud , ill intent , conspiring or bribing in implementing his contractual obligations .
c. In case the contract is terminated , the Establishment has the right to confiscate the performance bond of the contractor and all his entitlements along with suing him for the damages , expenses and charges as well as the rights emanating from the contract and the execution shall be at the expense of the contractor whatever the cost are without any notification .
The Fees And Expenses Emanating from The Contract :
The contractor bears all expenses, fees and charges resulting from the implementation of the contract in Syria and outside and also bears the expenses of the consular authentication of the documents in the country of origin and the expenses of the consular authentication in Syria. He also pays the contract stamp fees on the two copies of the contract and all commissions and expenses of opening the documentary letter of credit in Syria and outside Syria and the expenses of the import licence and the fees for the analysis of the samples in Syria and the expenses , fees and charges of the customs clearance in Syria .
The Establishment does not bear any expenses, charges or fees resulting from the execution of the contract whatever they reach and whatever their type is before loading the goods of board the carriers .
The contractor shall submit all his demands for the extension of the execution period of the contract as a result of sudden events or emergency or force majeure during the execution of the contract within fifteen days from the occurrence of the reason causing the delay and he should explain the reasons which force him to delay, and the contractor non-submission of such application during the prescribed period shall be considered a declaration from him that there are no reasons justifying any delay and consequently it is a waiver of his right to protest against the penalties resulting from this delay .
Commercial Agent : In case the tender is awarded to the bidder, he should appoint a commercial agent in Syria in accordance with Decree No. 15 for 2001 and its amendments and should determine a chosen address for the agent in Syria . The chosen address is binding him even if he moves to another if he does not notify the Establishment of his new address, otherwise all notifications sent to his first chosen address shall be considered inevitably valid .
Legal References :
This Book is subject to Law No. 51 for 2004 and Decree No. 450 for 2004 and the Syrian Arab legislation is governing the interpretation of any text not stipulated in this Book .
Disputes Solving : Disputes emanating between the parties shall be amicably solved and if they are not solved amicably the Syrian Administrative courts shall be considered the competent authority for solving the dispute .
Period the Bidder Sticks to His Bid :
The bidder sticks to his bid for (90) ninety days from the day following the closing day of the bid submission .
The bid shall be rejected if it contradicts with the Book of Conditions or when it is submitted after the prescribed period for accepting the bids or when the required bid bond is not submitted .
Remark : The Establishment alone has the right to increase or decrease the quantities of the contract at 25% and the contractor has no right to increase or decrease the quantities by his own accord without obtaining the written approval of the Establishment .

Book of technical conditions for importing lentils, chickpeas and beans


Quantities:
1- a- Red lentils of first class seeds, 500 ton (± 25%).
b- White lentils of first class seeds, 500 ton (± 25%).
d- Red ground lentils of first class seeds, 1500 ton (± 25%)
2- White chickpeas of first class 1500 ton (± 25%).
3- a- Dried kidney beans (wide), 100 ton (±25%)
b- White, dried and thin beans, 300 ton (± 25%).
d- Dried beans on the shape of the egg of pigeon (conglobated),
100 ton (± 25%)

Supplying shall start during 45 days from the date of commencement order.
Expenses of analysis shall be on the account of supplier.


Lentils

They are dried seeds extracted from leguminous plants.
Types:
1- White, oblate lentils of first class. The color of their seeds is white inclined to greenness, yellowness or light brownness. Diameter of their seeds shall not be less than 5 mm.
2- Red lentils of first class. The color of their seeds is dark red or dark brown, circular. Diameter of their seeds shall not be less than 3.5 mm.
3- Red ground lentils:

General conditions:
1- Intact and dried seeds from the new season, their smell is natural, empty from the seeds that are moldy, rotten, infected by rust, damaged (growing, worm-eaten), defects, strange things and seeds of harmful herbs. Also free from broken and split seeds and empty from living insects, provided that the rate of died insects doesn’t exceed 5 insect per kilogram.
2- The rate of moisture of lentils with all its types and class, shall not increase on 14 % by weight.
3- The rate of other sorts according to the table of tolerances in the defects of lentils are as follows

4- Ground lentils: shall be characterized by following features:
- To be empty from living insects. The rate of dead insects shall not exceed 5 insects per kilogram.
- Moisture shall not exceed 14%.
- Bodies shall not exceed 2 % including peel.
- None ground seed (clothed) 2% maximum.
- Pierced seeds shall not exceed 0.5 %
- Broken shall not exceed 1.5 % sifted by sieve 1.5 mm.
- From red type.

Chickpeas

They are dried chickpeas of white seeds inclined to yellowness and extracted from leguminous plants.

Types: White chickpeas inclined to yellowness. Their diameter shall not less than 9 mm.

General conditions:
1- Dried seeds shall be from the new season, their smell shall be natural, empty from dead and living insects with all its phases.
2- Free from moldy, fungus, seeds that are infected by hot bit or frostbite, and empty from the seeds of other herbs and types, and growing seeds, defects and strange things according to the following table:

Note:

If the rate of white chickpeas of first class decreased less than 80%, they shall be rejected, and they shall not be received.

3- The rate of moisture shall not exceed 14% by weight.

Dried beans

They are dried seeds, fully developed, extracted from beans plant.

Types:
1- Kidney beans or wide, they are oblate, similar to kidney or fava beans, of first class.
2- Thin white bean of first class, provided that the small seed sifted by sieve No. 7 mm, doesn't exceed 10 %.
3- Beans on the shape of the egg of pigeon (or conglobated) of first class, intermediate volume, closer to globular shape, from the new season.

General conditions:

1- They shall be from the new season, empty from strange smell and taste, completely developed, cleaned and intact.
2- Moisture rate in complete seeds shall not exceed 12 %
3- Qualitative weight shall not increase above 750 g/liter.
4- They shall be free from unnatural colorants.
5- The product shall be empty from mold, living insects or their ova and secreta and excretions of rodents, in such away the dead insects doesn’t increase on 5 dead insects in the one kilogram.
6- The rate of bodies shall not increase above 2 %.
7- The rate of gnawed and pierced seeds shall not increase above 2 %
8- The rate of broken seeds shall not increase above 2 %
9- The rate of colored seed shall not increase above 2%
10- The rate of crimped seeds shall not increase above 2%.


Healthy conditions of lentils, chickpeas and beans


1- The content of total Eflatoxin (B1-B2-G1-G2) shall not increase above 15 microgram per kg, provided that the value of Eflatoxin (B1) doesn’t exceed 5 microgram per kilogram.
2- The rate of radio pollution shall not increase on the limits permitted by competent authorities in Syrian Arab Republic.
3- The effects of germicides in seeds shall be within the permitted limits and that are issued from FAO.


Filling, inspection, and the ways of testing lentils, chickpeas and beans


Filling:

They shall be filled by solid, intact, cleaned and dried bags, empty from strange smells, manufactured from materials don't effect the taste of product, its color and smell, and at same time prevent it from effecting by external effects, filled by polyethylene bags, capacity 25 kg.

Inspection and the ways of test:

According to Syrian standards, and the samples shall be transferred to central laboratory to perform the required analysis properly.

Identification card of lentils, chickpeas and beans:

1- It shall be written on bag directly or on a card to be attached by clear writing in Arabic language, incapable to remove or change. It may be written by another language beside to Arabic language.
2- Name of filled material.
3- Name of producer or filler, his address and trademark.
4- Type and class.
5- Net weight by kg, i.e. : 25 kg, the weight of bag shall not accounted with the weight.
6- Country of origin.
7- Season or year of production.
8- It shall be written on bag "imported in favor of general establishment of sorting and marketing at Damascus.
